Protect yourself by hiring our Santa Fe criminal defense attorney to protect your rights during the following hearings:
Bail Hearing
As your lawyer, I will work to get you out of jail as soon as possible by arguing for lower bail or arranging for reasonable conditions of release. The sooner you are out of jail, the better, if possible.
Arraignment
Arraignment is the hearing where you enter your plea, typically not guilty, guilty, or no contest. You will receive my guidance and counsel during your arraignment.
First Appearance (Felonies Only)
An individual charged in magistrate court with a felony will appear for a felony First Appearance where no plea will be entered, and conditions of release will be imposed when the client is successfully released from custody.
Preliminary Hearing (Felonies Only)
An individual charged with felony crime(s) in magistrate court will have a probable cause hearing. This hearing is especially important and is the state’s opportunity to present evidence and testimony to prove that felony crime(s) has been committed and that the defendant committed the felony crime(s). The State has the burden of proof and must prove its case to a level of probable cause. It is an excellent opportunity for the defense to cross-examine every state witness presented and “test and challenge” the charges against him or her.
Pretrial Phase
The pretrial phase is the time when we exchange evidence, file motions, and argue with prosecutors before our trial ever takes place. This is an opportunity to obtain all material discovery, conduct a thorough defense investigation, interview witnesses, file suppression motions, and file other necessary motions as determined by each individual case. I will always move for a dismissal, acquittal, or plea deal, no matter what.
Judge or Jury Trial
If your case makes it to trial, then I will prepare your case to hit back at the prosecutor’s theory against you.
Sentencing
During the sentencing phase, if your case even gets that far, I will argue for the lowest possible sentence, fine, or penalty for your situation. You can be sure that I will have a strategy that works to enhance your results.
At every point in your case, I will be by your side to respond to handle the prosecutors, judges, and law enforcement personnel assigned. You will never be left wondering where your case stands or what will happen to you.
