Exercising All Legal Options

As your criminal defense lawyer, I can provide evidence and arguments against these initial steps, which lead to arrest. In many cases where charges are filed, I can arrange for a court appearance in place of my client being arrested and going to jail.

First Appearance or Arraignment Representation

If the complaint against you is already filed and you’ve been arrested, you will need to appear at an arraignment or first appearance. Here, the judge will advise you of your charges, minimum and maximum penalties, notify you of your constitutional rights, set bail, and impose conditions of release.

Helping You Obtain the Prosecutor’s Evidence Against You

As your attorney, I can argue for a release without posting the bond and for the fairest conditions of release. I will also enter a not guilty plea on your behalf and deny the allegations on your behalf, depending on whether the charges are misdemeanors or felonies. We will obtain discovery from the prosecution, review the discovery, begin a defense investigation, and prepare a defense as we continue to assess your case.

Penalties for Criminal Convictions in New Mexico

Criminal courts have the power to levy a variety of penalties if you are found guilty of a crime. Since state criminal laws are vast, it is critical that you speak with a criminal defense lawyer in Las Vegas, New Mexico to fully understand what you could be facing.

A preliminary hearing, also known as a preliminary examination, allows courts to screen felony-level criminal matters for probable cause. During this hearing, prosecutors must prove that a felony crime or crimes were committed and that the defendant committed the crime or crime. It prevents the “hasty and unwise prosecutions and to save an innocent accused from the humiliation and anxiety of a public prosecution.”
